How to Get an Uncontested Divorce in Oklahoma
Last reviewed August 1, 2026 · General information, not legal advice.
An "uncontested" divorce is one where both spouses agree on the key terms — how to divide property and debts, and (if you have children) custody, parenting time, and child support. In Oklahoma, an uncontested divorce is usually the fastest and cheapest way to end a marriage, and most people can complete the paperwork themselves.
Do you meet Oklahoma’s residency requirement?
Before you can file, at least one spouse must have lived in Oklahoma for at least 6 months (43 O.S. § 102(A)). You file in the county where you have lived for the 30 days before filing, or in the county where your spouse lives (43 O.S. § 103(A)(1)).
If you do not yet meet these requirements, you can still prepare your documents — just don’t file them with the court until you qualify, or the case may be dismissed.
What forms do you need?
A typical Oklahoma uncontested divorce packet includes a Civil Cover Sheet, a Petition for Dissolution of Marriage, an Automatic Temporary Injunction, a way to notify your spouse (a Summons or an Entry of Appearance & Waiver they sign), and a Decree of Dissolution.
If you have minor children, you’ll also need a Parenting Plan, a Child Support Computation, a UCCJEA affidavit, and usually an income-assignment form. If you can’t afford the filing fee, a Pauper’s Affidavit lets you ask the court to waive it.
How much does it cost?
There are two separate costs: the court filing fee (about $258 in most counties, paid to the court clerk) and, if you use a preparation service, its fee. Our documents are a flat one-time price — see our pricing.
How long does it take?
With no minor children, an Oklahoma divorce generally can’t be finalized until 10 days after filing. With minor children, there’s usually a 90-day waiting period and both parents must complete a parenting class (the court can waive the 90 days for cause).
The basic steps
1) Confirm residency. 2) Complete your forms. 3) File the Petition and pay the fee (or file a fee waiver). 4) Notify your spouse (waiver or service). 5) Complete any required parenting class. 6) Ask the clerk to set your uncontested hearing and bring your proposed Decree for the judge to sign.
Common questions
Can I get divorced in Oklahoma without a lawyer?
Yes. Oklahoma allows you to represent yourself (pro se). For an uncontested divorce where you and your spouse agree, most people complete the forms themselves. If your case is contested or complex, consider a licensed attorney.
What if my spouse won’t sign?
You can still proceed by formally serving them. If they don’t respond within the deadline, you may be able to proceed by default. If they actively disagree, your divorce is "contested" and this self-help route may not fit.
